HON'BLE SRI JUSTI CE A. RAMALI NGESWARA RAO Writ Petition No. 19722 of 2009 Order:

This Writ Petition was filed challenging the action of the second respondent in renewing the list of members of managing committee furnished by the fourth respondent by proceedings dated 16.07.2009 as violative of the proceedings dated 17.09.2005 of the second respondent. The Writ Petition was dismissed as against the respondents 5, 6 and 8 to 10. It is stated in the counter affidavit that the annual list submitted by the concerned society was taken on record and there is no question of recognizing or non-recognizing the list of managing committee.

In view of the stand taken in the counter affidavit and also in view of the passage of time, no purpose would be served in considering the present Writ Petition and, accordingly, the Writ Petition is dismissed as infructuous. However, this will not prevent the petitioner from taking appropriate proceedings in accordance with law. There shall be no order as to costs.

As a sequel thereto, the miscellaneous petitions pending in this Writ Petition, if any, shall stand closed.
