HON'BLE SRI JUSTI CE A. RAMALI NGESWARA RAO Writ Petition No. 38 of 2017 Order:

This Writ Petition was filed to quash the proceedings in FIR No.1129 of 2016 of Rajendranagar Police Station, Cyberabad, dated 12.11.2016.

This Court, while ordering notice before admission, granted stay of all further proceedings including arrest of the petitioner, by order dated 03.01.2017, and the said order is in operation. A reading of the complaint discloses an offence and the learned counsel for the petitioner tried to make a distinction between bailable offence and non-bailable offence. This Court, in exercise of power under Article 226 of the Constitution, cannot entertain such pleas when there is an alternative remedy available to the petitioner.

In the circumstances, this Writ Petition is disposed of giving liberty to the petitioner to avail the alternative remedy for the relief sought for in the present Writ Petition. In view of relegating the parties to alternative remedy, the interim stay granted on 03.01.2017 shall continue for a period of two (2) weeks from today. There shall be no order as to costs. As a sequel thereto, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
