HON'BLE THE ACTI NG CHI EF JUSTI CE RAMESH RANGANATHAN AND THE HON'BLE SRI JUSTI CE A.SHANKAR NARAYANA WRI T PETI TI ON No. 35945 OF 2016 ORDER (Per the Hon'ble the Acting Chief Justice Sri Ramesh Ranganathan) Sri S. Suri Babu, learned Special Standing Counsel for Commercial Taxes, on instructions, states that the auction proposed to be held on 27.10.2016 has been postponed as a single bid was received, that too only for Rs.75,00,000/-, as against the dues to the Government of more than Rs.2.00 Crores. Learned Standing Counsel would submit that a fresh notification would be issued calling for fresh bids for the sale of the subject property.

As the auction has not been held, and the respondents intend to issue a notification afresh, the cause in this writ petition does not survive. The Writ Petition is, accordingly, dismissed as infructuous leaving it open to the petitioner, if they so choose, to question the notification, which may be issued by the Government later, on all the grounds raised in this writ petition.

The miscellaneous petitions pending, if any, shall stand dismissed. There shall be no order as to costs.
