HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.1780 OF 2017 ORDER:

This writ petition is filed against the order dated 15.10.2015 in No.F3/2209/2007-F3/50/ROR/2007 filed under Section 9 of the A.P.Rights in Land and Pattadar Pass Books Act, 1971 passed by the 2nd respondent wherein the 2nd respondent dismissed the Revision filed by the father of the petitioners on the ground that petitioners' father died, inspite of the application of the petitioners to come on record as legal representatives of the Revision petitioner is pending.

Heard the learned counsel for the petitioners and the learned Assistant Government Pleader for Revenue. Though notices were ordered and served on the unofficial respondents, there is no appearance on behalf of them. Since the application of the petitioners to come on record as legal representatives is pending before the 2nd respondent, the 2nd respondent would not have dismissed the revision as abated. In view of the same, the impugned order dated 15.10.2015 is set aside and the 2nd respondent is directed to take up the application filed by the petitioners to come on records as legal representatives of the Revision petitioner in the Revision and dispose of the same in accordance with law. However, status-quo order granted by this Court on 19.01.2017 regarding entries in the revenue records shall be continued pending disposal of the Revision.

Accordingly, the writ petition is allowed to the extent indicated above. No costs.

As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed. _____________________________ A.RAJASHEKER REDDY, J 02.03.2017 dv
