THE HONOURABLE SMT. JUSTICE K. SUJANA CRIMINAL PETITION No.12507 OF 2025 ORDER :

This criminal petition is filed under Section 480 & 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') by the petitioner/Accused seeking enlargement on bail in connection with FIR No.141 of 2025 of Kotapally Police Station, Ramagundam. The offences alleged against the petitioner are under Section 75 of Bharatiya Nyaya Sanhita, 2023 and under Section 8 and 12 of Protection of Children from Sexual Offences (POCSO) Act, 2012.

The case of the prosecution is that the students of 9th class and 10th class of Kotapalli Ashram School staged Dharna in front of the said school for which the District Collector, Mancherial appointed the District Minority Welfare Officer for enquiry. On enquiry, the victims revealed that the petitioner herein harassed while teaching in 9th and 10th classes and who used to be alone sexually and abusively by touching them and also used to comment over their body shape. As such the District Child Protection officer lodged a report on 26.07.2025 against the petitioner for taking necessary action. Basing on the said complaint, the police registered the case against the accused.

Heard Sri Kondadi Ajay Kumar, learned counsel for the petitioner and Sri D.Arun Kumar, learned Additional Public Prosecutor appearing for the respondent-State. 4.

Learned counsel for the petitioner contended that petitioner is innocent of the said allegations and no such offence is committed by him. The petitioner is falsely implicated in this case by some of his colleagues by colluding with the parents of some of the students and got arranged Dharna in front of the school. The petitioner is in jail from 26.07.2025 and that material part of investigation is completed. Hence, requested this Court to grant bail to the petitioner.

On the other hand, learned Additional Public Prosecutor opposed bail stating that the allegations against the petitioner are serious in nature. Petitioner being a principal mis-behaved with the students. As such, prayed this Court to dismiss this petition.

Considering the submissions made by the respective parties and the material placed on record, the petitioner is in jail from 26.07.2025 and as material part of investigation is completed including recording the statements of victims, this

- 3 - Court deems it fit to grant bail to the petitioner subject to the following conditions:

i.

The petitioner/Accused shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only), with two sureties for a like sum each to the satisfaction of Judicial First Class Magistrate, Chennur.

ii. The petitioner/Accused shall appear before the concerned SHO at 11:00 a.m., on every Wednesday for a period of eight (8) weeks, for the purpose of investigation and thereafter, as and when required.

iii. The petitioner/Accused shall abide by the conditions stipulated in Section 483(2) of BNSS. 7.

Accordingly, the Criminal Petition is allowed. Miscellaneous petitions, if any, pending shall stand closed.
