HON'BLE SRI JUSTI CE A. RAMALI NGESWARA RAO Writ Petition No. 25662 of 2014 Order:

This Writ Petition was filed challenging the inaction of the respondents in granting final registration certificate on the application submitted by the petitioner seeking permission to undertake Aquaculture activity in R.S.Nos.56/2, 56/5, 56/6 and 56/5 in an extent of Ac.1.77 cents, situated at Aravalli village, Athili Mandal, West Godavari District. This Court, by order dated 11.09.2014, permitted the petitioner to carry on digging operations but he was restrained from commencing the Aquaculture activities till final registration is granted. It was also made clear that the digging operations would be subject to further orders of the District Level Committee and the petitioner shall not claim any equity. The second respondent was directed to dispose of the application filed by the petitioner on 28.10.2013.

Now, a counter affidavit is filed stating that the petitioner had proceeded with the pond digging and violated the terms and conditions of G.O.Ms.No.7 dated 16.03.2013. However, the application of the petitioner was considered in terms of amended G.O.Ms.No.15 dated 26.04.2015 and permission was granted on 28.01.2016. In view of the same, no further orders are necessary in the present Writ Petition. The Writ Petition is, accordingly, closed. There shall be no order as to costs.

As a sequel thereto, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
