HON'BLE SRI JUSTICE U.DURGA PRASAD RAO CRIMINAL PETITION No.5835 of 2017 ORDER:

In this petition filed under Sections 437 and 439 of the Code of Criminal Procedure, 1978, the petitioners/A.1 and A.2 seek regular bail in Crime No.197 of 2017 of Sanathnagar Police Station, Cyberabad, which was registered for the offences punishable under Sections 376, 376 (D) and 342 IPC.

The allegation is that the de facto complainant, who is a married lady, went to the house of A.1 to purchase rice, A.1 with the assistance of A.2 committed rape on her. The investigation is reported to be pending and charge sheet is yet to be filed.

Having regard to the gravity of the offence and pending investigation, it is not a fit case to grant bail to the petitioners at this stage. The petitioners can renew their application after filing of the charge sheet. 4.
