I.Satyanarayana Reddy v. B.Naveen Kumar Reddy
THE HON'BLE SRI JUSTICE M. SATYANARAYANA MURTHY Crl.P.MP.No.18809 of 2016 In/AND COMMON ORDER:
Crl.P.M.P.No.18809 of 2016 is filed seeking leave of this Court to compound the offences, in view of the settlement of dispute due to intervention of elders.
2. The offences alleged to have committed by the petitioners are under Sections 420 and 406 of IPC and Section 156(3) Cr.P.C. 3.
Both the parties are present-in-person and they are identified by their respective counsel and the parties are also produced photostat copies of Aadhar Cards in proof of their identity. On enquiry, both the petitioners and respondent/ de facto complainant stated that they entered into compromise and the petitioner paid the disputed amount to the respondent so as to lead peaceful life in future. Even if the trial is continued, the chances of supporting the prosecution case by witnesses are bleak and such trial would end in futility.
4.
Having considered the facts and circumstances of the case and in view of the joint memo filed by both parties and in view of the judgment of the Apex Court in Gian Singh v. State of Punjab
MSM,J and another1 it is a fit case to grant permission to compound the offences as it would not have any impact on the society. 5.
Accordingly, Crl.P.M.P.No.18809 of 2016 is allowed.
6. In view of the orders passed in Crl.P.M.P.No.18809 of 2016, the proceedings in Crime No.1016 of 2015 on the file of Police Station, Vansthalipuram, Cyberabad, are quashed.
Accordingly, Crl.P.No.1008 of 2016 is allowed.
Miscellaneous Petitions, if any, pending in this Criminal Petition, shall stand closed.
