HONOURABLE SRI JUSTICE M.S.K. JAISWAL TRANSFER CRIMINAL PETITION No. 205 of 2016 ORDER:

This Transfer Criminal Petition is filed seeking to transfer CC.No.488 of 2016 pending adjudication on the file of the learned Judicial First Class Magistrate, Suryapet, Nalgonda District to the Court of the learned Judicial First Magistrate, Godavarikhani, Karimangar District.

The petitioner herein is one of the witnesses to the crime registered under FIR No. 94 of 2016 on the file of the Station House Officer, Police Station, Suryapet Town. He is neither an accused in the aforesaid crime nor a party to the Calendar Case, but only a witness. Therefore the ground on which the petitioner is seeking transfer of the aforesaid Calendar Case is not justifiable and merits no consideration.

The Transfer Criminal Petition is dismissed.

Miscellaneous petitions pending consideration if any in the Transfer Criminal Petition shall stand closed in consequence. No order as to costs.
