THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.7685 OF 2016 ORDER:

This petition is filed by the petitioner-accused seeking to relax the conditions imposed by the III Additional Metropolitan Sessions Judge, Ranga Reddy District at L.B. Nagar in Crl.M.P.No.977 of 2016 in Crime No.409 of 2016.

The learned Additional Public Prosecutor opposed this petition. The petitioner filed the above Crl.M.P. seeking to grant anticipatory bail. The learned Sessions Judge passed the following conditional order:

"The petitioner-accused is granted conditional anticipatory bail for ten days only. The petitioner-accused is directed to execute a personal bond for Rs.25,000/- with two sureties each for a like sum to the satisfaction of the Station House Officer, L.B. Nagar in the event of his arrest or else petitioner is at liberty to surrender before the learned II Metropolitan Magistrate, Cyberabad at L.B. Nagar forthwith and the learned II Metropolitan Magistrate, Cyberabad at L.B. Nagar is directed to enlarge the petitioner on above conditions. The petitioner shall co-operate to the police for the purpose of investigation. After completion of stipulated period of ten days, he is directed to surrender before the learned II Metropolitan Magistrate, Cyberabad at L.B. Nagar to apply for regular bail."

Considering the facts and circumstances of the case, and since the time granted by the learned III Additional Metropolitan Sessions Judge has already elapsed, this Court is of the view that the present petition is not maintainable.

Accordingly, the Criminal Petition is dismissed. However, the petitioner is at liberty to approach this Court by way of an application for anticipatory bail, if he is so advised.
