HON'BLE SRI JUSTICE A. SHANKAR NARAYANA Criminal Petition No. 4015 of 2015 Order:
The instant Criminal Petition is filed, under Section 482 of the Code of Criminal Procedure, 1973, to direct the Special Judicial Magistrate of First Class (Prohibition and Excise Offences), Nalgonda, to return the passport to the petitioner, who is arraigned as accused in Calendar Case No.527 of 2014 on its file, for the offences punishable under Sections 498-A IPC and Sections 3 and 4 of the Dowry Prohibition Act, 1961.
2. Heard both sides.

Learned counsel for the petitioner submits that, though, an order was passed by the learned Magistrate on 31.12.2014, directing the prosecution agency to produce the witnesses by 12.01.2015 and even directed the concerned prosecution agency to complete the examination of witnesses within two months, but the same was not complied with and the petition filed by the petitioner for return of passport was dismissed and that the petitioner intends to go to London for his employment as he was earlier working as Radiographer in UCLH, Central London, United Kingdom.
4. Perused the material on record.

Since the passport relates to the petitioner/accused, against whom the offences under Indian Penal Code and Dowry Prohibition Act have been alleged and the Calendar Case is pending on the file of the Special Judicial Magistrate of First Class (Prohibition and Excise Offences), Nalgonda, a direction can be given to the learned Magistrate to dispose of the Calendar Case No.527 of 2014 as expeditiously as
possible, preferably within a period of three (3) months from the date of receipt of a copy of this order and the concerned police are also directed to produce the witnesses without seeking unnecessary adjournments including LW.6 who is shown to have been residing at London.
6. With the above direction, the Criminal Petition is disposed of. 7 . As a sequel thereto, the miscellaneous applications, if any, pending in the Criminal Petition shall stand closed.
