THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.5735 OF 2016 ORDER:
This petition is filed by the petitioner-accused No.4 under Section 482 Cr.P.C. seeking to quash the proceedings against him in FIR No.324 of 2016 on the file of Rajendranagar Police Station, Cyberabad, registered for the offence punishable under Sections 409, 420, 120-A and 120-B IPC.
Heard and perused the material available on record. The allegation against the petitioner is that after performance of marriage of the 2nd respondent with A1, he failed to hand over Marriage certificate to her. It is alleged that A1 to A5 conspired together to cheat the 2nd respondent.
Considering the facts and circumstances of the case and the allegations made against the petitioner, this Court is not inclined to grant the relief sought by him. However, the petitioner is directed to surrender before the Station House Officer concerned on or before 5th May, 2016. On such surrender, he shall be released on bail on his executing a personal bond for a sum of Rs.50,000/- (Rupees Fifty Thousand only) with one surety for the like sum to the satisfaction of the Station House Officer concerned. The 1st respondent-police are directed to complete the investigation, without arresting the petitioner. In the event of necessity, the 1st respondent-police are directed to issue a notice to the petitioner to appear before the investigating agency for the purpose of investigation. On issuance of such notice, the petitioner is directed to appear before the investigating agency and give an undertaking as to his future appearance as and when required for the purpose of investigation.
