ORDER
When the matter is taken up for hearing, Sri A.Rama Rao, learned counsel appearing for the petitioners submits that all the petitioners are employees of the respondent-Bank; that the respondent-Bank had come up with voluntary retirement scheme in the year 2000; that in pursuance of the said scheme, the petitioners have applied and all of them retired from service; that as per Regulation 29(5) of the Syndicate Bank (Employees) Pension Regulations,1995, the petitioners are entitled to count five years of additional qualifying service while calculating their pension benefits, but the case of the petitioners was rejected by the respondents vide proceedings dated 24.2.2003 on the ground that Clause 29(5) of the said Regulations has no application to them. Learned Standing Counsel appearing for the respondent-Bank contends that the respondent had rightly rejected the case of the petitioners; and that the petitioners are not entitled for counting five years qualifying service for the purpose of calculating pensionary benefits.
Having considered the rival submissions made by the learned counsel on side, this Court is of the view that ends of
justice would be met if a direction is given to the respondentBank to re-consider the case of the petitioners. Accordingly, the Writ Petition is disposed of directing the respondent-Bank to re-consider the entire case of the petitioners without being influenced by the earlier rejection order dated 24.02.2004 and pass appropriate orders, in accordance with law, within a period of four weeks from the date of receipt of a copy of this order. No costs. Miscellaneous petitions, if any, pending shall stand closed.
