THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No. 9107 of 2022 ORDER:
This Criminal Petition is filed under Section 438 of the Code of Criminal procedure, 1973 seeking pre-arrest bail to the petitioner who is arrayed as Accused No.4 in the event of his arrest in FIR No.92 of 2022 on the file of Station House Officer, Hadnoor Police Station, Sangareddy District, registered for the offences punishable under Sections 341, 307 and 506 read with 34 of Indian Penal Code (for short "IPC"). 2.
Heard learned counsel for the petitioner and learned Assistant Public Prosecutor for the respondent-State. Perused the record. 3.
The petitioner, other accused persons and the de facto complainant are neighbours. With regard to land, there was an altercation in between both the parties. On 21.06.2022, both the accused group and the complainant group quarreled with each other and persons from both the sides received injuries and the present crime was registered against these petitioner and others. On the basis of the complaint given by this petitioner and others, a Crime was registered vide Crime No.93 of 2022 against the complainant and others.

As seen from the remand report, the injuries sustained by the de facto complainant were treated and he was discharged. Accused Nos.1, 2 and 5 were arrested and granted the relief of regular bail on 15.09.2022. For the reason of there being no specific allegation against this petitioner in the remand report, the petitioner can be granted the relief of anticipatory bail.

Accordingly, the Criminal Petition is allowed and the petitioner/Accused No.4 shall be enlarged on bail in the event of his arrest subject to the following conditions:
i) The petitioner/Accused No.4 is directed to surrender before the Station House Officer, Hadnoor Police Station, Sangareddy District, within ten (10) days from today, and on such surrender, he shall be enlarged on bail on his executing personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand Only) with two sureties to the like sum each, to its satisfaction.
ii) On such release, the petitioner/Accused No.4 shall appear before the concerned Station House Officer on every Monday and Thursday between 10.30 AM and 01.00 PM for a period of eight (06) weeks and thereafter as and when required for the purpose of investigation.
iii) The petitioner/Accused No.4 shall abide by the other conditions stipulated in Section 438(2) Cr.P.C.
