HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.4275 of 2011 ORDER:

This writ petition is filed by the petitioner aggrieved over the proceedings in Roc.No.173/A3/2003, dated 3.2.2011 issued by the 1st respondent.

It is the case of the petitioner that a shop in a complex constructed by the 1st respondent was leased out to him for doing tailoring work and as per the directions of the 1st respondent, he is paying the rent regularly and that the petitioner has been paying the rent at the rate of Rs.250/- per month from the year 1986. While so, the 1st respondent issued the proceedings impugned enhancing the rent to Rs.2,200/- per month. Aggrieved over the same, the petitioner filed this writ petition. 3.

Heard and perused the material available on record. 4.

On 25.2.2011, while admitting the writ petition, this Court suspended the proceedings impugned on condition of the petitioner paying rent at the rate of Rs.1,000/- per month with effect from March, 2011. 5.

Now, taking into consideration the changed circumstances, this Court is inclined to pass the following order:

(1) The petitioner is directed to pay the rent in respect of the schedule shop at the rate of Rs.1,500/- (Rupees One Thousand and Five Hundred only) per month to the 1st respondent commencing from the month of January, 2017;

(2) The respondents are directed not to take any action on the basis of the proceedings impugned against the petitioner.

However, this order will not stand in the way of the respondents to take appropriate steps in accordance with law. 6.

Accordingly, the Writ Petition is disposed of. No costs. Consequently, miscellaneous petitions pending, if any, shall stand closed. ________________ RAJA ELANGO, J Date: 17th January, 2017 Nn
