THE HONOURABLE SRI JUSTICE C.PRAVEEN KUMAR WRIT PETITION No.4833 OF 2008 ORDER:

This Writ Petition, under Article 226 of the Constitution of India, came to be filed seeking the following relief: " ... to issue an appropriate Writ, Order or direction preferably one in the nature of Writ of Mandamus, declaring the action of the Respondent in not registering the Cancellation Deed dated 30-12-2006 presented by the petitioners herein for cancellation of the earlier registered sale deed dated 22-12-2006 vide Document No.700/2006 on his file, as arbitrary, illegal and contrary to law and consequently direct the respondent to register the said Cancellation Deed forthwith and pass such other or further orders as are necessary."

When the matter is taken up for hearing, it is brought to the notice of this Court that, in view of the ratio laid down by the Full Bench of this Court in Yanala Malleshwari and others vs. Ananthula Sayamma and others1, the appropriate Forum wherein the petitioners can redress their grievance, would be the Civil Court.

Hence, giving liberty to the petitioners to avail the remedy provided under the above judgment, the Writ Petition is disposed of.
