HON'BLE SRI JUSTICE GUDISEVA SHYAM PRASAD WRIT PETITION No. 791 of 2016 ORDER:

This Writ Petition is filed for a Mandamus to declare the action of respondent, in not considering the petitioner's application dated 06.01.2015 for issuance of fresh passport, as illegal, arbitrary and violative of Articles 14, 15 and 16 of the Constitution of India.

Heard the learned Counsel for the petitioner and learned Assistant Solicitor General for Central Government. Learned Counsel for the petitioner submits that his application dated 06.01.2015 for issuance of fresh passport was not considered by the respondent.

Learned Assistant Solicitor General appearing for the respondent submits that the petitioner had not made the application as per Office Memorandum dated 22.09.2016; and the respondent would follow clauses (i) and (iv) of additional guidelines of Office Memorandum dated 22.09.2016 while considering petitioner's application for issuance of fresh passport.

In view of the submissions made by both the counsel, respondent is directed to consider the petitioner's application for issuance of fresh passport as per clauses (i) and (iv) of additional guidelines of Office Memorandum dated 22.09.2016.

The Writ Petition is disposed of accordingly.
