THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.2498 OF 2016 ORDER:
This Criminal Petition is filed under Section 482 of Code of Criminal Procedure (Cr.P.C.) to quash the proceedings in C.C.No.59 of 2015 on the file of the IV Metropolitan Magistrate at Ibrahimpatnam, registered for the offences under Sections 447 and 427 IPC. Heard and perused the material available on record. Learned counsel for the petitioners submits that there are disputes between the petitioners and the second respondent/complainant. He further submits that in view of the civil suits pending, the complainant filed a false complaint against the petitioners. Hence, he prays this Court to quash the proceedings against the petitioners herein.
This Court is of the view that truth or otherwise of the allegations made against the petitioners can be decided only after due trial. The contentions raised by the learned counsel for the petitioners are to be tried by the Court below and hence, this Court is not inclined to interfere with the proceedings against the petitioners.
