HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 19789 of 2016 ORDER:
Heard learned counsel for the petitioners and learned counsel appearing for the respondents. With the consent, the writ petition is taken up for disposal at the admission stage itself. The present writ petition came to be filed seeking issuance of writ of mandamus declaring the high handed action of the respondents in attempting to demolish the petitioners' building admeasuring 538 square yards bearing Door Nos.3-14/1 and 3-14/1A, Dwaraka Tirumala, West Godavari District, without notice to the petitioners, as illegal, arbitrary, biased, unconstitutional and violative of provisions of the Land Acquisition Act, 1894 and other G.O.s; and consequently direct the respondents not to demolish the petitioners' building.
Learned counsel for the petitioners submits that though the building is in existence since last 100 years and though enough space is available on either side of the road, the respondent authorities are trying to demolish the petitioners' house bearing Door Nos.3-14/1 and 3-14/1A, Dwaraka Tirumala, West Godavari District, without giving any notice and following due process of law.
Learned counsel appearing for the respondents stated that any action done by the respondents will be in accordance with law.
Recording the submission made by the learned counsel for
the respondents and having regard to the circumstances of the case, the present Writ Petition is disposed of, directing the respondents not to take any coercive steps without following the procedure contemplated under law. No order as to costs. Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
