HONOURABLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.15160 OF 2003 ORDER:

This writ petition is filed seeking to issue a writ of Certiorari calling for the records relating to the proceedings dated 20.1.2003; to quash the same and consequently, to direct the respondent-Corporation to protect the petitioners' pay on par with their juniors with effect from 9.5.1990 together with all consequential and attendant benefits. 2.
Heard Sri P.B. Vijaya Kumar, learned Counsel for the petitioners and Sri S.V. Ramana, learned Standing Counsel for the respondent.

It is the case of the petitioners that they were appointed as junior clerks in the year 1975, 1996, 1976 and 1976 respectively. When they were appointed as such, the entire State remained as one unit for the purpose of recruitment, promotions and seniority. Subsequently, the respondent-Corporation was bifurcated into ten regions. Then, the petitioners were allotted to Vizianagarm District. It is the grievance of the petitioners that the persons, who were appointed along with them and who were allotted to
other regions, are drawing more salary on promotion as senior clerks and in that regard, the petitioners submitted a representation to the respondents. But the said representation was rejected by the respondents vide proceedings dated 20.1.2003.

The learned Counsel for the petitioners contended that the petitioners were initially appointed as Junior Clerks and subsequently, they were promoted as senior clerks ahead of their juniors, but in spite of the same, the respondents are extending more scale of pay to their juniors.

The learned Standing Counsel for the respondent contended that the petitioners can compare themselves with the employees of their region, but they cannot compare themselves with the employees of other regions and contend that they are being paid less salary. 6.
Having considered the rival submissions made by the parties, this Court is of the view that ends of justice would be met if the writ petition is disposed of directing the petitioners to submit a representation to the respondent.

Accordingly, the Writ Petition is disposed of directing the petitioners to submit a representation to the respondent regarding their claim within a period of two weeks from the date of receipt of a copy of this order. On such representation being received, the respondent shall reconsider the entire issue and pass appropriate orders, within a period of four weeks thereafter. No costs. Consequently, miscellaneous petitions pending, if any, shall stand closed.
