THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.15793 of 2008 ORDER:

This Writ Petition is filed challenging the Order No.275/2007 in O.A.No.199/2005, passed by the 1st respondent-Deputy Commissioner of Endowments, Kakinada, on 04.04.2008. This matter was listed on 01.11.2016, however, since there was no representation on behalf of the petitioner, it was directed to be listed under the caption "for dismissal". Thereafter, on 08.11.2016, learned counsel for the petitioner appeared and sought time. Therefore, the matter was listed on 16.11.2016, 07.12.2016, 05.07.2018. On 05.07.2018, the learned counsel represented that the petitioner is no more and he seeks time to bring on record his legal representatives. Hence, the matter was adjourned by two weeks and listed on 19.07.2018, on which date, at the request of the petitioner, it was again adjourned to 27.08.2018.

However, there was no representation for the petitioner and the file also does not indicate any L.R. Application having been filed on behalf of the deceased petitioner. In those circumstances, the matter was directed to be listed on 17.09.2018, on which date, again it was directed to be listed on 01.10.2018. Today also, there was is representation on behalf of the petitioner, though the matter is listed under the caption 'for dismissal', and there is also no L.R. Application filed. In those circumstances, it is presumed that the petitioner is no longer interested in pursuing the matter.

Accordingly, the Writ Petition is dismissed as abated. No costs.

Consequently, Miscellaneous Petitions pending, if any, shall also stand dismissed.
