THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.32810 of 2012 ORDER:

This Writ Petition was filed seeking a direction to respondent Nos.1 to 3 to conduct a thorough investigation in Crime No.1313 of 2012 and alter the Section from 324 IPC to Section 307 IPC while filing the charge sheet.

Learned Government Pleader produced before me a copy of the instructions received by him on 12.02.2016 stating that the investigation was taken up in FIR No.1313 of 2012. Accused Nos.1 to 4 were arrested on 14.09.2012 and were produced before the learned II Metropolitan Magistrate, Cyberabad at L.B.Nagar. The charge sheet was filed against accused Nos.1 to 4 vide C.C No.361 of 2013. The learned XIV Metropolitan Magistrate, Cyberabad at L.B.Nagar, acquitted accused Nos.2, 3 and 4 and convicted accused No.1 with one year simple imprisonment and fine of Rs.5,000/- on 03.08.2015. In view of the above facts, nothing survives for adjudication in the present Writ Petition and the Writ Petition is, accordingly, dismissed as infructuous.
