HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO CRIMINAL PETITION No.6518 OF 2015 ORDER:

This Criminal Petition is filed by the petitioners/A1 to A3 under Section 482 Cr.P.C seeking to quash the proceedings in F.I.R.No.12 of 2015 of Rajahmundry II Town Police Station, registered for the offence punishable under Sections 324, 506 and 354 r/w 34 I.P.C.

Heard the learned counsel for the petitioners and the learned Public Prosecutor (Andhra Pradesh) for the State before notice to respondent No.2/de facto complainant and before admission.

The above crime was registered on the report of respondent No.2/de facto complainant, for the alleged outraging the modesty of LWs.3 and 4. According to the accused, at the post crime stage, A2 was taken to custody and submitted with remand report and the remand report of A2 is part of the record placed reliance by the petitioners show no offence under Section 354 is made out against any of the petitioners and there remain only offence under Section 324 I.P.C. insofar as A1 and A2 and Section 323 I.P.C. so far as A3 and also 506 r/w 34 I.P.C. against them. As A2 is already enlarged on regular bail, the petitioners 1 and 3 are entitled to the concession of bail. Hence, this application is disposed of giving liberty to the petitioners to surrender before the learned Magistrate and move for regular bail with notice to Additional Public Prosecutor and in

such an event the learned Magistrate shall hear and grant bail on the same day with necessary conditions. Needless to say, at the post bail stage pending investigation, the presence of the petitioners before the Court can be dispensed with. In the event of police filing final report or charge sheet, further remedy is left open to the petitioners.
