HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION No. 30025 of 2015 ORDER:

The petitioner was appointed as a permanent fair price shop dealer of shop No.37, Abbaipalem Village, Darsi Mandal, Prakasam District. While so, the shop of the petitioner was inspected on 06.04.2015 and, on the basis of the report submitted by the Food Inspector, Podili, 6A proceedings were initiated and are pending before the second respondent. On the basis of the report of the inspecting officer, a show cause notice was issued by the third respondent on 22.04.2015 framing three charges against the petitioner. The petitioner submitted his explanation on 01.05.2015 and, after considering the same, an order of suspension was passed on 23.05.2015. Against the said order, the petitioner preferred an appeal to the second respondent on 27.07.2015, along with a stay application and, when the same was not disposed of, the present Writ Petition is filed.

The allegations against the petitioner relate to variation in the quantities of rice, sugar and kerosene oil. The impugned order of suspension was passed on May, 2015 and, enquiry should have been completed by now and, since enquiry was not completed, this Court does not want to interfere with the enquiry process.

In the circumstances, the third respondent is directed to complete the enquiry, by giving due opportunity to the petitioner, and pass final orders, within a period of thirty days from the date of receipt of a copy of this order.
