THE HON'BLE SRI JUSTICE S.V.BHATT W.P.No.9618 of 2012 ORDER:

The petitioners challenge proceedings of Joint Collector and Additional District Magistrate, Prakasam-2nd respondent, dated 18-02-2012.

Through the proceedings impugned in the writ petition, the assignments made in favour of petitioners have been cancelled under Board Standing Orders 15 (2) read with 15 (18)(1). Admittedly, the petitioners have remedy before the Chief Commissioner of Land Administration, and this Court prima facie is of the view that the petitioners ought to have availed the remedy before the said authority.

Mr.M.Subba Reddy requests four weeks time to pursue the remedy available before the said authority.

The Assistant Government Pleader does not oppose the request of Sri M.Subba Reddy to work out the remedies before the Chief Commissioner of Land Administration. Hence, the petitioners are given four weeks time from the date of receipt of a copy of this order to work out the remedies available before the said Authority. If the petitioners pursue the remedy as permitted by this Court, without reference to delay,

the said authority is directed to number the case and dispose of the same in accordance with law on merits.

The parties are directed to maintain status-quo in all respects as on date for a period of eight weeks from today and further orders can be obtained from the competent authority. The writ petition is disposed of accordingly. No order as to costs.
