HON'BLE SRI JUSTICE S. RAVI KUMAR TRANSFER C.M.P.No.669 of 2013 ORDER:
This petition is filed to withdraw O.P.No.511 of 2013 from Family Court, Vijaywada, and transfer the same to Family Court, Nalgonda.
2. Wife filed this petition and according to her affidavit, her marriage with respondent was performed on 11.12.2010 at Vijaywada.
She contended that respondent and his family members harassed her and when she became pregnant she was sent to her parents' house and thereafter she was not taken back by respondent and she gave a complaint before Women Police Station, Nalgonda, which is registered as Crime No.74 of 2013 and subsequently she filed M.C.No.22 of 2013 before Family Court, Nalgonda and respondent in order to harass her filed the above O.P. before Family Court, Vijaywada, for restitution of conjugal rights. She further stated that it is difficult for her to attend Vijaywada Court, which is at a distance of 180 Km. and that she is not in a position to bear the travelling expenses being an un-employee and dependent on her parents. She further stated that respondent is attending Nalgonda Court in connection of M.C.No.22 of 2013 and Crime No.74 of 2013 and no prejudice would be caused to him if the above O.P. is transferred from Vijaywada to Nalgonda.
3. Respondent in spite of service of notice neither
appeared in person nor through any Advocate.
4. Heard advocate for petitioner.
5. Considering the reasons stated in the affidavit and also considering the fact that respondent is attending Family Court, Nalgonda in connection of M.C.No.22 of 2013 and as both the cases have to be tried by one Court to avoid conflicting decisions, O.P.No.511 of 2013 is withdrawn from Family Court, Vijaywada, and transferred to Family Court, Nalgonda, to be tried along with M.C.No.22 of 2013.
6. Accordingly, the transfer C.M.P. is ordered. No costs.
7. Miscellaneous Petitions pending, if any, shall stand dismissed.
