HON'BLE SRI JUSTICE S. RAVI KUMAR TRANSFER C.M.P.No.632 of 2015 ORDER:

This petition is filed to withdraw O.P.No.2083 of 2014 from Additional Family Court-cum-XVI Additional District Judge, Malkajgiri, Ranga Reddy District, and transfer the same to Family Court-cum-Additional District Judge, Karimnagar.

2. Wife filed this petition and according to her affidavit her marriage with respondent was performed on 15.04.2012 at Karimnagar Town and they lived happily for a period of one year and thereafter disputes arose and that she was left at her parents' house and thereafter she lodged a complaint with police on 05.05.2014, which was registered as Crime No.54 of 2014 and also filed D.V.C. case before Additional Judicial First Class Magistrate, Karimnagar. She further stated that she filed M.C.No.19 of 2014 before Family Court, Karimnagar and the Family Court granted maintenance. She stated that husband filed O.P.No.2083 of 2014 before Ranga Reddy Court to harass her. She further stated that she is living under the mercy of her parents and facing inconvenience and it is difficult for her to attend Malkajgiri Court for each and every adjournment. She stated that she has life threat in the hands of respondent and his family members at Hyderabad and Ranga Reddy, therefore, she prayed for transfer of O.P.No.2083 of 2014 from Malkajgiri Court to Family Court, Karimnagar.

3. Respondent in spite of service of notice neither appeared in person nor through advocate.

5. Advocate for petitioner submitted that respondent is attending Karimnagar in connection of 498-A IPC case, D.V.C.

case and petition filed for execution of maintenance order and no prejudice would be caused if this O.P.No.2083 of 2014 is also transferred to Karimnagar.

Considering reasons stated in the affidavit and also considering the convenience of wife, O.P.No.2083 of 2014 is withdrawn from Additional Family Court-cum-XVI Additional District Judge, Malkajgiri, Ranga Reddy District, and transferred to Family Court, Karimnagar, for disposal in accordance with law.

7. Accordingly, this transfer C.M.P. is ordered.

8. Miscellaneous petitions pending, if any, shall stand closed.
