THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.21432 OF 2016 ORDER:

Heard the learned counsel for the petitioner, the learned Government Pleader for Municipal Administration and Urban Development, for respondent No.1 and Sri M.Praveen Kumar, learned Standing Counsel for Nagara Panchayat at Vemulawada, for respondent No.2. With consent of the counsel appearing for both sides, the present writ petition is disposed of at the admission stage.

2 . The present writ petition came to be filed with the following prayer:

"to issue a Writ, order or direction, more particularly one in the nature of a Writ of Mandamus declaring the action of second respondent in repeatedly visiting petitioner under construction building in open plot situated in Survey No.887, situated at 1st By-Pass Road, Jagtiyal Kaman, Vemulawada Town and Mandal, Karimnagar District and threatening with demolition as arbitrary, illegal."

3. Though various grounds are raised in the writ petition, learned counsel for the petitioner restricts his prayer seeking a direction to the 2nd respondent not to interfere with the construction of the building of the petitioner without following due process of law.

4. Learned Standing Counsel for the 2nd respondent submits that the averments in the affidavit filed in support of the writ petition are all false and the respondent authorities will not

interfere with the construction of the petitioner's building except in accordance with law.

5. Having regard to the circumstances stated above and without going into the merits of the case, the Writ Petition is disposed of directing the 2nd respondent not to initiate any action in respect of construction of the building of the petitioner, without following due process of law.

Consequently, Miscellaneous Petitions, if any, pending in this writ petition shall stand closed. There shall be no order as to costs.
