THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.27261 of 2018 ORDER:
Heard Ms.B.Tara Sujatha for petitioner and the learned Assistant Government Pleader for respondents. The petitioner on 30.06.2018 applied in Form No.VI (A) of the A.P.Rights in Land and Pattadar Pass Books Act, 1971 and Rules 1989 (for short 'the Act' and 'the Rules'). The acknowledgment of the said application is evidenced through post acknowledgment dated 04.07.2017. The present writ petition is filed complaining inaction in disposing of the said application and passing orders under the Act and the Rules.
The Assistant Government Pleader placed on record, the written instructions dated 03.08.2018.
Keeping in view the limited prayer of petitioner, this Court, at this juncture, does not refer to other instructions given in this behalf. Suffice it to note that the application is not considered by 2nd respondent as the same is not applied through Mee-Seva.
The instructions on this aspect read thus:
"Further I also submit that Sri E.Thirumalesu and D.Venkatesh of Demakethepalli Village of Chilamathur Mandal have not applied for issue of pattadar passbook through meeseva"
The writ petition under the above circumstances is disposed of by this order:
(a) The petitioner is given liberty to apply for pattadar passbook through Mee-Seva within two (02) weeks from today.
(b) Within one (1) week thereafter, the petitioner is given liberty to send copy of application made through Mee-Seva by registered post with acknowledgment due, by enclosing a copy of this order.
(c) The 2nd respondent considers and passes orders as are fit in the circumstances of the case within four (04) weeks, thereafter. No order as to costs.
Miscellaneous petitions, if any, pending, shall stand closed.
