COMMON ORDER:

Heard learned counsel for petitioner and Sri N Vasudeva Reddy, learned standing counsel for respondent corporation. 2.

According to petitioner, he was working as Conductor. On 10.11.2008 while returning from duty he met with an accident near Asifnagar Petrol Pump, Hyderabad injuring his right leg. He was admitted to Osmania General Hospital; later shifted to RTC Hospital at Tarnaka; he underwent treatment for a period of two months and later his case was referred to NIMS, Hyderabad, where he was operated upon and big part of whole was cut and removed and iron rod was fixed; he was discharged from hospital on 29.11.2008. NIMS hospital has issued certificate dated 26.3.2009 advising him to take up sedentary duty. Petitioner alleged to have made several representations to assign alternative job. This writ petition is filed praying to declare the action of respondents in not providing alternative employment based on medical certificate dated 20.11.2012 issued by Osmania General Hospital and to consequently direct the respondents to provide alternative employment. 3.

By order dated 13.3.2014 this Court having noticed that petitioner suffered 83 % physical deformity directed the respondents to consider the representation of petitioner dated 16.12.2013 by duly taking into account the physical deformity suffered and the disability as calculated

by the competent doctors within a period of eight weeks from the date of receipt of copy of said order.

Alleging disobedience of the said orders dated 13.3.2014, Contempt Case No. 1110 of 2014 is filed. Today, when these two matters are taken up, learned standing counsel for respondents produced copy of the letter of the Regional Manager, Hyderabad dated 27.1.2016. Reading of the letter would disclose that on due consideration of the representation of the petitioner dated 16.12.2013, petitioner was appointed as Record Tracer and posted to IBP Depot against existing vacancy and has been working as such.

In view of the fact that interim orders dated 13.3.2014 of this Court are complied with, Contempt Case No. 1110 of 2014 is closed. 6.

Since alternative employment is provided to the petitioner, the cause in the writ petition does not survive and accordingly the same is disposed of. However, it is open to the petitioner to avail appropriate remedy, regarding any other service grievance, if so advised.
