THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.24343 OF 2016 ORDER :

This writ petition is filed seeking writ of mandamus declaring the action of the respondents in trying to lay the road from the house plot of the petitioner total to an extent of 582 sq.yds in Sy.No.550/4, situated at Sabbepally village, Hazipur Grampanchayat, Mancherial Mandal, Adilabad District by dispossessing her, without even issuing any notice and without following due procedure contemplated under law, though the respondents earlier acquired the land and house properties of the petitioner and her husband for the construction of Sripada Sagar Yellampally Project as illegal and arbitrary and contrary to the provisions of the Land Acquisition Act and consequently to direct the respondents not to dispossess the petitioner from the house plot to an extent of 582 sq.yds in Sy.No.550/4, situated at Sabbepally Village, Hazipur Grampanchayat, Mancherial Mandal, Adilabad District for the purpose of laying the road.

Heard learned counsel for the petitioner and learned Assistant Government Pleader for Irrigation.

Learned Assistant Government Pleader for Irrigation produced written instructions vide Lr.No.EE/SYP/Dn.1/RDM/TS/701/M, dated 21.07.2016 stating that no activity is being taken in the petitioner's land admeasuring 582 sq.yds in Sy.No.550/4 as on today; that the land is not handed over to the said department and also that they have not given any requisition for acquiring the above said land for development.

Recording the submission of the learned Assistant Government Pleader for Irrigation, this writ petition is disposed of. There shall be no order as to costs.

As a sequel thereto, miscellaneous petitions, if any, pending in this writ petition, shall stands closed.
