Heard Mr. Bollam Lingaiah Yadav for petitioner and the learned Government Pleader for Civil Supplies for respondents. 2.

Petitioner challenges the proceedings dated 23.12.2016 directing to dispose of the seized stock through public auction and remit the sale proceeds realized into the treasury account. According to petitioner, the enquiry under Section 6-A of the Essential Commodities Act, it is stated, stands posted to 21.01.2017 at 11 AM before the second respondent.

This Court is of the view that the direction issued through impugned proceeding for sale of seized stock need not be proceeded with for the enquiry is scheduled to be held on 21.01.2017. Having regard to these limited circumstances, the writ petition is disposed of by this order:

a) The auction directed through proceeding dated 23.12.2016 is stayed for a period of four (4) weeks from today.

b) The second respondent is directed to complete the enquiry within three (3) weeks from today and communicate the order to petitioner.

The writ petition is disposed of. As a sequel, the miscellaneous applications pending, if any, shall stand closed. There shall be no order as to costs.
