HON'BLE SRI JUSTICE C.PRAVEEN KUMAR AND HON'BLE SRI JUSTICE T.AMARNATH GOUD I.A.No.1 OF 2018 In/And F.C.A.No.100 OF 2016 JUDGMENT: (per Hon'ble Sri Justice C.Praveen Kumar) This Appeal is preferred under Section 19 of the Family Courts Act, aggrieved by the order and decree dated 30.11.2015 passed in O.P.No.441 of 2008 on the file of the Judge, Family Court, Ranga Reddy District at L.B.Nagar, Hyderabad, whereunder the petition filed by the petitioner-appellant under Section 13(1)(ib) of Hindu Marriage Act for dissolution of marriage, was dismissed.

During the pendency of the appeal, learned counsel on either side filed I.A.No.1 of 2018 seeking to record compromise entered into by the petitioner and the respondent. It is stated in the affidavit filed in support of the said application that at the intervention of elders and well-wishers, both the parties have amicably settled the matter and to that effect a Memorandum of Compromise was also entered into which is also filed under Order XXIII, Rule 3 read with Section 151 CPC. The terms of the said compromise would show that both the parties agreed for a decree of divorce by dissolving the marriage dated 24.08.2000; that the appellant has agreed to pay an amount of Rs.5,00,000/- (Demand Draft bearing No.525055) to the

respondent-wife and Rs.5,00,000/- (Demand Draft bearing No.525056) to their minor daughter towards full and final settlement. Further both the parties agreed to exchange all Gold, Silver and other valuable articles and the minor daughter Kum.Pravallika shall be with the respondent.

The respondent is present before this Court. When questioned, the respondent stated that she has agreed for the terms of compromise and received the demand drafts bearing Nos.525055 and 525056 (Rs.5,00,000/- each) drawn on Andhra Bank, towards full and final settlement.

In view of the same, I.A.No1 of 2018 is ordered and the Appeal is disposed of in terms of the Memorandum of Compromise dated 16.2.2018 entered into between the parties and the marriage between the petitioner and respondent is hereby dissolved by granting a decree of divorce, in terms of the said compromise.
