THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CRIMINAL REVISION CASE No.2566 of 2017 ORDER:

This revision is preferred under Sections 397 and 401 of Code of Criminal Procedure (fort short "Cr.P.C.") questioning the propriety and legality of the order dated 24.08.2017 passed in Crl.A.No.206 of 2015 by the XVI Additional District and Sessions Judge, Nandigama confirming the conviction and sentence passed in C.C.No.218 of 2014 by the Additional Judicial First Class Magistrate, Nandigama finding the petitioner guilty for the offence punishable under Section 138 of Negotiable Instruments Act (for short "N.I.Act") The trial Court found the petitioner - accused guilty for the offence punishable under Section 138 of N.I.Act and sentenced to pay fine of Rs.72,000/- and out of which the complainant is entitled to receive an amount of Rs.70,000/- as compensation and the remaining fine of Rs.2,000/- shall be deposited to the State, in default the accused shall undergo simple imprisonment for a period of three (3) months.

The petitioner paid fine amount of Rs.2,000/- to the credit of State, but did not pay compensation of Rs.70,000/- so far.

Though raised several grounds in the grounds of revision, Ms.D.Sherley, learned counsel for the petitioner fairly conceded that the petitioner is ready to pay

MSM,J Crl.R.C._2566_2017 compensation of Rs.70,000/- in four equal monthly instalments commencing from 01.11.2017.

In view of the request made by the learned counsel for the petitioner, I need not decide the merits of the revision, but the petitioner is directed to pay compensation of Rs.70,000/- in four equal monthly instalments commencing from 01.11.2017. In the event of failure to pay any instalment, the respondent No.2 is at liberty to enforce the order by following necessary procedure under Sections 421 and 428 of Cr.P.C. With the above direction, the criminal revision case is disposed of. No costs.

The miscellaneous petitions pending, if any, shall also stand closed.
