THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 29969 of 2017 O R D E R:

Petitioner, claiming to be the Sarpanch of Gangapur Gram Panchayat, filed this writ petition challenging the action of respondent Nos.1 to 4 in proceeding to construct a building for the Police Station in Survey No.342 of Gangapur Village, Rebbena Mandal, Kumuram Bheem District.

Learned Government Pleader for Home placed before this Court a copy of the written instructions received from the Sub-Inspector of Police, Adilabad District, dated 13.09.2017. The written instructions disclose that as there is a need for construction of Circle Inspector's Office, respondent No.4 - Superintendent of Police, Adilabad District had approached respondent No.2 - District Collector seeking allocation of suitable land and after considering the same, respondent No.2 had directed the Mandal Surveyor to identify the suitable land and according to him, in Survey No.342, existing building is in an extent of Ac.0.14 guntas and Ac.0.24 guntas is available at the back side of the Circle Inspector's Office. The entire land, which is inclusive of existing Police Station, would be Ac.0.38 guntas and the same has been demarcated and handed over to the Police Department for construction. In the circumstances, there is no illegality about the construction being made by the Police Department.

Admittedly, the land in question belongs to the Government and as there is a requirement to construct a Police Station, as an extension to the existing Police Station, to cater the needs of public, this Court does not find any illegality in the action of respondent Nos.1 to 4 in proceeding with the construction of police station. However, alternative prayer of the petitioner deserves consideration.

As the land in question, as on date, is being used for the purpose of conducting weekly cattle fair, respondent No.2 shall allocate a suitable land for continuation of cattle fair, as it is stated that huge revenue is getting accrued to the Gram Panchayat therefrom from time to time.

Therefore, the writ petition is disposed of giving liberty to the petitioner to submit a detailed representation setting out the particulars and need to respondent No.2, who, in turn, shall consider the same in accordance with law, within a period of five weeks from the date of receipt of such representation. Miscellaneous petitions, if any, pending in this writ petition shall stand closed. There shall be no order as to costs. _________________________ CHALLA KODANDA RAM, J Dt:15.09.2017 kdl
