The petitioner/Accused filed the present application under Section 438 Cr.P.C. to release him in the event of his arrest in connection with Crime No.166 of 2015 of Bheemili Police Station, Visakhapatnam District, registered for the offence punishable under Section 380 IPC.

After arguing for some time, learned counsel for the petitioner requested the Court to permit the petitioner to surrender before the Court concerned and file an application for grant of bail. 3.

Acceding to the request of learned counsel for the petitioner, without touching the merits of the case, I deem it appropriate to permit the petitioner to surrender himself before the Court concerned and move an application for grant bail, in which event, the learned Magistrate is directed to consider the application on the same day after serving notice to the Public Prosecutor. 5.
