HONOURABLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No. 17615 of 2015 ORDER:

Heard learned Counsel for the petitioner and learned Government Pleader for the respondents.

The petitioner is the absolute owner and possessor of the land to an extent of Ac.11.67 cents in Sy.Nos.219/1, 219/2, 219/3, 219/4 and 218/1 situated at Chinnalingala Village, Nandivade Mandal, Krishna District. He submitted an application to the third respondent on 31.01.2014 in terms of G.O.Ms.No.7 dated 16.03.2013 seeking permission for conversion of the subject land into aquaculture farms. The Mandal Level Committee and Divisional Level Committee recommended the application of the petitioner. However, no orders have been passed by the second respondent so far. Challenging the same, the present Writ Petition is filed.

In view of the facts narrated above, this Court is not inclined to pass orders for conversion of the subject lands into aqua culture farm since the application of the petitioner is pending consideration before the second respondent. In view of the same, the Writ Petition is disposed of directing the second respondent to consider the application of the petitioner dated 31.01.2014 and dispose of the same in accordance with G.O.Ms.No. 7 dated 16.03.2013 within a period of two months from the date of receipt of a copy of this order. The Writ Petition is disposed of. Miscellaneous petitions pending consideration if any in the Writ Petition shall stand closed in consequence. No order as to costs.
