THE HON'BLE SRI JUSTICE M. SATYANARAYANA MURTHY CRIMINAL PETITION No.14598 OF 2016 ORDER:

This petition is filed under Section 482 of the Code of Criminal Procedure 1973 (for short, 'Cr.P.C.') to quash the proceedings in Crime No.338 of 2015 of Jagathgirigutta police station, Cyberabad, Ranga Reddy, registered against the petitioner and another for the offence punishable under Sections 3(1)(x) and 3(1)(xi) of SC /ST (Prevention of Atrocities) Act, 1989 and Sections 354 and 506 of the Indian Penal Code, 1860. The petitioner is A.1 in the said crime. It is the specific allegation made against the petitioner that while the daughter of defacto complainant by name A.Swetha, was studying intermediate II year at Sri Gayathri Junior College, got down the college bus, the petitioner forced to love him. On 05.12.2016 at about 6.

30 AM when she was at the bus stop Gajularamaram for auto to go to her house, the petitioner caught hold her hand and forced her to love him, otherwise he will pour acid on her face, and threatening to kill all the family members, abused her in filthy language raising her caste name and thus, the allegations made in the complaint clearly attracts the offence under 3(1)(x) and 3(1)(xi) of SC /ST (Prevention of Atrocities) Act, 1989 as the said Swetha belongs to schedule community, and caught hold her hand and forced her to love him, and threatened to pour acid, prima facie, amounts to an offence punishable under Sections 354 read with 506 of the Indian Penal Code.

CRLP_14598_2016 MSM, J - 2 - Thus, the allegations made in the complaint are sufficient to proceed with further investigation in the crime and I find no ground to quash the proceedings in Crime No.338 of 2015 of Jagathgirigutta P.S., Cyberabad.

Hence, the criminal petition is dismissed.

Miscellaneous petitions, if any, pending in this criminal petition, shall stand closed.
