Petitioner is challenging the order of removal dated 20.01.2017. The service conditions of Field Assistants are governed by Field Assistants Human Resources Policy. As per para No.13 of the Policy, a person aggrieved by the decision of original authority imposing punishment is provided with remedy by way of appeal to the District Collector. Petitioner has not exhausted the said remedy of appeal. No reason is stated as to why remedy of appeal is not availed.

Learned counsel for the petitioner sought to contend that though elaborate explanation was submitted by the petitioner, enclosing the documents, those documents were not considered. 4.

Having regard to the above, this Court is not inclined to express any opinion on the said issue, at this stage, as it would prejudice the claim of the petitioner in his appeal and also close the mind of the appellate authority in considering the appeal. Suffice to note that as petitioner has remedy by way of appeal, this Court is not inclined to entertain the writ petition. 5.

Granting liberty to the petitioner to avail the remedy of appeal against the order of termination of his service, the Writ Petition is dismissed. It is needless to observe that as and when such appeal is filed, the same shall be considered objectively by the appellate authority, by duly taking note of the contentions urged in the appeal and appropriate orders be passed by assigning

due reasons in support of the decision. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
