THE HON'BLE SRI JUSTICE U.DURGA PRASAD RAO CRIMINAL PETITION No.148 of 2015 ORDER:

Heard learned counsel for petitioner and the learned Public Prosecutor for respondent and perused the impugned order. Learned counsel for petitioner submits that furnishing of bank guarantee for a period of 3 years or disposal of case for release of Rs.1,20,000/- as ordered by learned Principal Sessions Judge, Khammam, will cause any amount of hardship to the petitioner/accused and therefore, the said condition may be substituted with any other suitable condition.

Learned Public Prosecutor left the matter to the discretion of the Court.

Considering the hardship pleaded, the Criminal Petition is allowed and while upholding the Order dated 11.11.2014 in Crl.R.P.No.53 of 2014, the condition imposed by the learned Principal Sessions Judge, Khammam, directing the petitioner/accused to furnish bank guarantee for Rs.1,20,000/- for a period of 3 years or till the disposal of the case, is hereby modified and instead the petitioner/accused is directed to furnish a 3rd party property security to a tune of Rs.1,20,000/- ( Rupees One Lakh Twenty Thousand Only) to the satisfaction of the learned Judicial Magistrate of First Class, Special Mobile Court, Khammam and on furnishing such surety, the amount of Rs,1,20,000/- ( Rupees One Lakh Twenty Thousand only) has to be released to him. As a sequel, Miscellaneous Petitions pending in this Criminal Petition, if any, shall stand closed.
