THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.28902 of 2015 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking the following relief:

"to issue a writ, order or direction, particularly one in the nature of Writ of Mandamus, declaring the action of the respondents in threatening the petitioner to marry the 5th respondent and get the marriage registered in the office of the Sub-Registrar, Warangal, and also to declare the action of the respondents to take 5th respondent to his house and to lead marital life as illegal, arbitrary and consequently direct the respondents not to interfere with the liberty of the petitioner, and pass such other order or orders may deem fit and proper interest he circumstances of the case."

Heard Sri A.Prabhakar Rao, learned counsel for the petitioner and learned Government Pleader for Home for respondents 1 to 4, apart from perusing the material available before this Court.

When the matter is called, the written instructions dated 10.09.2015 furnished by the Sub-Inspector of Police, Atmakur, Warangal District, has been placed on record by the learned Government Pleader, which read as under:

" It is respectfully submitted that as per the records, it is revealed that, no complaint whatsoever was received or registered against the petitioner herein on the file of Atmakur Police Station, Warangal District.

It is submitted that the allegation of the petitioner that the 5th respondent appeared to have gave a report to the 3rd respondent stating that she fell in love with him and asked them to get her marriage to be performed with him and that the

police on the basis of the complaint of the 5th respondent started harassing him and threatening him and that on 18.8.2015 the police started harassing him to marry the 5th respondent in a temple or in the registration office at Warangal and when he refused to marry the 5th respondent, they beat him blue and black and left him with a threat that he has to come within 2 weeks and marry the 5th respondent is absolutely false, baseless and hence denied.

It is submitted that the allegation of the petitioner that the 3rd and 4th respondents are harassing his parents to agree and to give consent to marry the 5th respondent and that his parents did not agree for the proposal and his parents left the village unable bear the harassment of the police is utterly false, baseless and hence the same is denied. It is pertinent to submit that it appears that the dispute of the petitioner as well as the 5th respondent herein is purely internal and civil matter and hence this respondent police has nothing to do with it. I humbly submit that as of now, no complaint whatsoever was received from the 5th respondent herein or from her parents. I humbly submit that at any point of time, this respondent police insisted the petitioner to marry the 5th respondent either in temple or at Registrar Office as alleged. I humbly submit that to settle his personal scores with the 5th respondent, the petitioner made baseless allegations against this respondent police and hence no credence can be given to it.

I humbly submit that this respondent never interfered with the life and liberty of the petitioner herein. As a precautionary measure to prevent the police from taking any action in the event of lodging of any complaint in future, the petitioner filed the present writ petition on mere apprehension." On noticing the above contents, it is requested by the learned counsel for the petitioner to record the same and dispose of the writ petition.

In view of the above, the writ petition is disposed of, placing on record the instructions dated 10.09.2015 furnished by the Sub-Inspector of Police, Atmakur, Warangal District. Pending miscellaneous petitions, if any, shall stand closed in the light of this final order. There shall be no order as to costs.
