THE HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION NO.13465 OF 2017 ORDER:

Heard learned counsel for the petitioner and learned Government Pleader for respondents 1 and 2.

This Writ Petition is filed challenging the action of the second respondent in interfering with the life and liberty of the petitioner pursuant to registration of FIR No.32 of 2017 dated 20.02.2017 on the complaint lodged by the third respondent.

Learned counsel for the petitioner submits that the name of the petitioner is "T. Rajaram Goud" only, but not "Rajarao" as mentioned in the complaint. The petitioner has nothing to do with the above crime and the police are insisting the petitioner to accept the accusation against 'Rajarao'. He further submits that if there is any evidence to the police to show that the petitioner is also called as "Rajarao", it is open to the police to take appropriate legal proceedings.

In view of the above, the Writ Petition is disposed of directing the second respondent to continue the investigation while keeping in view the contention of the petitioner with regard to the name and only after satisfying that the petitioner is also called as "Rajarao", the second respondent

shall proceed with the investigation. It is needless to observe that the second respondent while investigating the matter shall follow due process of law. There shall be no order as to costs.

As a sequel thereto, the miscellaneous petitions, if any pending in this Writ Petition, shall stand closed. _______________________________ (A. RAMALINGESWARA RAO, J) 17.04.2017 Vs
