THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI Writ Petition No.11216 of 2010 ORDER:

This writ petition is filed seeking the following relief/s: 'to issue writ, order or direction, more particularly one in the nature of writ of mandamus declaring the action of the respondents in conducting public auction of Lease Hold Rights of the land admeasuring an extent of Ac.7.14 cents in R.S.No.64 of Teeparru Village, Pervali Mandal, West Godavari District on 20.05.2010 which is in possession of the petitioner ignoring the notices of the 2nd respondent dt.12-12-2005 as illegal and arbitrary and contra to the provisions of the A.P. Charitable Hindu Religious Institutions and Endowment Act consequently directing the respondent to stop all further proceeding and pass such other order...' [Reproduced verbatim] As there was no representation for the writ petitioner on 06.11.

2015 the matter was directed to be listed under the caption 'For Dismissal'. Despite listing the matter under the caption 'For Dismissal', there is no representation for the petitioner. The learned Standing Counsel appearing for the 3rd respondent would submit that the lease term was already over and that nothing survives for adjudication and that, therefore, the writ petition has become infructuous. A reading of the relief portion in the writ petition also would show that it relates to the public auction of leasehold rights of the subject land to be held on 20.05.2010.

However, as there is no representation for the petitioner despite listing the matter under the caption 'For Dismissal, it indicates that the petitioner is not interested in pursuing the litigation.

Therefore, the Writ Petition is dismissed for default. There shall be no order as to costs.

Miscellaneous petitions pending, if any, in this writ petition shall stand closed.
