ORDER

This petition under Section 482 Cr.P.C. is filed by the petitioner/A2 seeking to quash the proceedings in Cr.No.55 of 2016 of Kanchikacherla Police Station, registered for the offence punishable under Section 420 r/w 34 IPC, against him.

2. It is alleged in the complaint that based on the representations of some persons, the de facto complainant being the Tahsildar, Kanchikacherla Mandal, Krishna District, gave a report stating that even though the said persons have purchased plots in Rs.No.381/2B and R.S.No.382/1 of Ganiatkuru Village in the year 2013, the accused have not registering the said plots in their favour, thereby cheated them. Based on the complaint, the aforesaid crime was registered against the accused.

3. Since the matter arising out of civil dispute, it has to be decided after full fledged trial. Therefore, this Court is not inclined to interfere with the impugned proceedings. However, the concerned police are directed to complete the investigation without arresting the petitioner/A2 and file a final report, if any, in accordance with law. The petitioner herein is directed to appear before the investigating agency as and when required and cooperate with the investigating agency.

4. With the above direction, the Criminal Petition is disposed of. Miscellaneous petitions, if any, pending in this petition shall stand closed.
