THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.9143 OF 2022 O R D E R:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure (for short "Cr.P.C") seeking regular bail to the petitioner who is arrayed as Accused No.9 in Crime No.693 of 2021 pending on the file of Station House Officer, Uppal Police Station, Rachakonda registered for the offences punishable under Sections 376(2) of Indian Penal Code and Sections 5, 6 and 17 of POCSO Act and Sections 3, 4, 5 and 6 of Prevention of Immoral Trafficking Act.

Heard learned counsel for the petitioner/Accused No.9 and learned Assistant Public Prosecutor for the respondent-State. Perused the record.

The Uppal police registered the aforesaid crime and according to their investigation this petitioner was a customer who approached Accused Nos.1 and 2 who were running brothel house. 4.

According to the case of the prosecution, having knowledge that the girl/victim was a minor, the petitioner allegedly had intercourse with her in the premises.

Keeping in view the completion of investigation and also that this petitioner is a customer and further it is not alleged that this petitioner was instrumental in trafficking girls. For the said reasons, the prayer for regular bail can be considered. 6.

Accordingly, the Criminal Petition is allowed and the petitioner/Accused No.9 is granted bail subject to the following conditions:

i) The petitioner/Accused No.9 is directed to be released on bail on his executing personal bond for a sum of Rs.50,000/- (Rupees Fifty Thousand only) with two sureties each for a like sum (among which one local and one native surety), to the satisfaction of VI Additional Metropolitan Magsitrate at Hastinapuram, L.B.Nagar. ii) After release on bail, the petitioner/Accused No.9 shall appear before the trial Court on every date of hearing without fail, failing which the prosecution is at liberty to move for cancellation of bail granted to this petitioner/Accused No.9. iii) The petitioner/Accused No.9 shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C.
