THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION Nos.37191 & 37619 of 2015 COMMON ORDER:

The grievance of the petitioners in these two cases is common. According to them, the police authorities are preventing them from entering into Nadichagi Village, Kowthalam Mandal, Kurnool District, without legal basis. A consequential direction was sought by them to the police authorities not to obstruct them from entering into the village.

Written instructions dated 24.11.2015 were furnished in both the cases by the SubInspector of Police, Kowthalam Police Station, Kurnool District, to the office of the learned Government Pleader for Home, wherein he stated that though the petitioners were involved in criminal cases and had been subjected to arrest earlier, no steps were taken by the police authorities to prevent them from entering into the village. The Sub-Inspector stated that rowdy sheets had been opened in the names of some of the petitioners in accordance with the due procedure and except for watching their activities, there was no obstruction by the police to their entering into the village. He further stated that due to fear of their opponents, the petitioners themselves were not coming back to their houses.

He categorically stated that the police authorities never threatened the petitioners or obstructed them from entering into the village. The aforestated stand of the police authorities is taken on record. In the light thereof, no adjudication is warranted on merits in either of these cases and they are accordingly closed.

Pending miscellaneous petitions, if any, shall also stand closed. No order as to

costs.
