THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.11179 OF 2023 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/Accused in Crime.No.143 of 2023 on the file of Garla Bayyaram Police Station, Mahabubabad District, registered for the offences under Sections 354 (D), 363 and 366 of IPC and Section 11 r/w. 12 of POCSO Act, 2012.

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the respondent-State and perused the record.

The case of the prosecution is that the daughter of the complainant was aged around 17 years and she went missing on 10.10.2023. Accordingly, a complaint was lodged on 11.10.2023 suspecting this petitioner as the person responsible. On 14.10.2023, the victim girl returned and she was taken to the Police Station, where she narrated the facts stating that she is in love with this petitioner. She was induced by this petitioner and accordingly she went out with him. They spent sometime in railway station and bus stand and returned.

Since the offences alleged against this petitioner are punishable less than 7 years and there is no allegation of aggravated sexual assault, this Court deems it appropriate to grant the relief of regular bail to the petitioner, subject to following conditions:- i) The petitioner/Accused shall execute personal bond for a sum of Rs.25,000/- (Rupees Twenty Five thousand only) with two sureties, for a like sum each to the satisfaction of the Judicial First Class Magistrate, at Mahabubabad District.

ii) The petitioner/Accused after release shall appear before the concerned Station House Officer on every Monday at 10:00 a.m. for a period of four weeks for the purpose of investigation and thereafter, as and when required.

iii) The petitioner/Accused shall abide by the other conditions stipulated under Section 437(3) of Cr.P.C. 5.

Accordingly, this Criminal Petition is allowed.

Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
