THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No. 17197 of 2015 ORDER:

Heard learned counsel for the petitioner and learned standing counsel for the respondents 1 and 2.

2. The petitioner appeared for the Common Law Admission Test of 2015 and obtained rank of 10774 on all India basis with a score of 16 marks. She secured State Rank No.18 and State Category Rank No.1, as she claimed reservation under Scheduled Tribe Category. Based on the said information, this Court by order dated 15.06.2015 directed the respondents 1 to 3 to reserve one seat unfilled in the 2nd respondent University, subject to further orders. Now, it is submitted by the learned standing counsel for the respondents 1 and 2 that the petitioner claimed to have belonged to Andhra Pradesh in her application and her application was treated under Andhra Pradesh area and she was allotted to the 3rd respondent University.

Now, it is agreed by the parties that the total seats available are 105, out of which, 21 seats are reserved for Telangana students and 84 seats are earmarked for all India students. Out of 21 seats reserved for Telangana students, 2 seats are earmarked for Scheduled Tribe students and out of 84 seats earmarked for all India students, 6 seats are earmarked for the Scheduled Tribe students. The last candidate in the General Quota secured more marks than that of the petitioner and this Court wanted to verify whether the petitioner can be accommodated in the Scheduled Tribe Category. Even in that Category also, the last candidate, who was allotted a seat, secured more marks than that of the petitioner.

woman candidate was accommodated. The learned standing counsel for the respondents 1 and 2 submits that there are woman candidates who secured more marks than that of the petitioner and in that view of the matter also, the petitioner is not eligible to get a seat in the 2nd respondent University.

3. In the circumstances, this Court finds no point in admitting the Writ Petition and the same is accordingly dismissed.

4. As a sequel, the interim order dated 15.06.2015 is vacated and the miscellaneous petitions, if any, pending in the writ petition shall stand closed.
