This petition is filed, seeking for relaxation of the conditions imposed by the XIII Additional District & Sessions Judge (FTC), Vijayawada, by order, dated 18.01.2018 in Crl.M.P.No.2159 of 2017.

Heard the counsel for the petitioners as well as the Public Prosecutor, appearing for the respondent.

The impugned condition is that the petitioners have to furnish two sureties for a sum of Rs.25,000/ - and out of the said surety, one surety was directed to be a local surety.

The petitioners seeking for modification of the said order filed Crl.M.P.No.1195 of 2018 in Crl.M.P.No.2159 of 2017 before the court of VII Additional Metropolitan Sessions Judge (FTC), Vijayawada. By virtue of the order, dated 29.06.2018, said petition was allowed and the court modified the order lifting the condition of local surety. The petitioners come before this court seeking for further modification of the said order, to the extent of reducing the surety amount from Rs.25,000/ - to Rs.10,000/ -. 4.

The counsel for the petitioners submits that the petitioners are not in a position to furnish the said surety. He also relies on an order, dated 02.02.2018, passed by this court in Crl.P.No.724 of 2018 in respect of A13.

Hence, by virtue of the same, this court opines that this is also a fit case for modification of the order. 6.

Accordingly, the Criminal Petition is allowed and the condition imposed by the XIII Additional District & Sessions Judge (FTC), Vijayawada, by order, dated 18.01.2018 in Crl.M.P.No.2159 of 2017, is modified by reducing the surety amount from Rs.25,000/ - to Rs.10,000/ -.

As a sequel, the miscellaneous applications, if any pending, shall stand closed.
