The relief sought for in this writ petition is to declare the action of the respondents in trying to dispossess the petitioners from their respective huts/sheds situated in Survey Nos.22/2P of Pineapple Colony, Mudasarlova, Visakhapatnam Rural Mandal, Visakhapatna during the pendency of the appeal dated 05.01.2015 filed by them before the 2nd respondent as illegal and arbitrary. Heard both sides.

In respect of the same cause of action, admittedly the petitioners have already availed the remedy of appeal before the 2nd respondent and an interim application for grant of stay of all further proceedings during the pendency of the appeal is also said to be pending. The petitioner cannot be permitted to prosecute two parallel proceedings against the same cause of action.

Therefore, the writ petition is disposed of directing the 2nd respondent to pass appropriate orders in accordance with law within a period of four (4) weeks from the date of receipt of a copy of this order.
